DHS document: 68,000 illegal immigrants with criminal convictions released in 2013

U.S. Immigration and Customs Enforcement officials last year released 68,000 illegal immigrants with criminal convictions, undercutting Democratic claims that President Obama has strictly enforced immigration laws.

An internal Department of Homeland Security document compiling statistics on arrests and deportations in 2013 showed that ICE agents encountered 193,357 illegal immigrants with criminal convictions but issued charging documents for only 125,478. More than 67,800 were released.

The data came from an end-of-year “Weekly Departures and Detention Report.”

The Center for Immigration Studies, a research group that favors stricter enforcement of immigration laws, estimates ICE agents released more than a third of illegal immigrants with criminal records they detained.

“ICE released 68,000 criminal aliens in 2013, or 35 percent of the criminal aliens encountered by officers. The vast majority of these releases occurred because of the Obama administration’s prosecutorial discretion policies,” Jessica Vaughn, director of policy studies at the Center for Immigration Studies, wrote in a memo summarizing the DHS document.

ICE classifies illegal immigrants as criminal if they have been convicted of a crime, not including traffic offense, Vaughn noted.

Sen. Jeff Sessions (Ala.), the ranking Republican on the Budget Committee, blasted the administration’s record.

“The preponderance of the evidence demonstrates that immigration enforcement in America has collapsed. Even those with criminal convictions are being released. DHS is a department in crisis,” he said in a statement Sunday.

“Secretary Johnson must reject the president’s demands to weaken enforcement further and tell him that his duty, and his officers’ duty, is to enforce the law – not break it,” he added in reference to Homeland Security Secretary Jeh Johnson.

A spokeswoman for ICE did not immediately respond to a request for comment.

Advocacy groups on both sides of the immigration debate have fired salvos back and forth over Obama’s track record enforcing the law.

Republicans say they cannot trust Obama to enforce the law and Speaker John Boehner (R-Ohio) cited that as an obstacle to passing immigration reform through the House.

Pro-immigrant groups argue Obama has enforced the law too zealously.

Janet Murguía, the president of the National Council of La Raza, called Obama the “deporter-in-chief” earlier this month.

Senate Democrats such as Sen. Bob Menendez (D-N.J.) have called on Obama to halt the deportations of illegal immigrants who are immediate family members of U.S. citizens.

The Center for Immigration Studies reports that ICE officials moved to deport 28 percent fewer illegal immigrants from the interior of the country in 2013 than in 2012.

The group obtained the law enforcement records through a lawsuit.

Then and only then, should any time and money which is covered by the citizens of these United States of America whom Veterans defend, should focus be unto those who HAVE invaded these Unites States of America.

The Veteran abuse in the above photo happens ALL to often and is so wide spread that Veterans are so inundated with the maze of VA paperwork and/or hoops to jump through, that ALL too many are forced to live rough, give up and often become nothing more than part of the statistics of the alarming increase in suicides amongst Veterans.

Hispanic/Latino ILLEGALS have invaded the U.S.A. without any real concern, care or reflection on the harm they are doing to U.S.A. citizens.

The Obama/Soetoro Treasonous administration has welfare agencies and others directing U.S.A. men and women into the sink hole of being welfare dependent, as well as, cutting back on procreating all the while ILLEGALS are given the keys to the U.S.A.. A sickening part of all this is that foreign governments are dictating that their citizens be taken care of which more times than not, are better than U.S.A. citizens receive.

ILLEGALS are being given work in the U.S.A. to kinda give the impression that they are helping and being worth while citizens, but this is only a diversion. The real fact of the matter is that there aren't enough jobs to go around and to cover up the invasion, U.S.A. citizens are either steered as cattle to slaughter by becoming welfare dependent, or being forced to live in the woods, on streets and/or anywhere they can to just survive.

Soup kitchens and/or shelters are in place for U.S.A. citizens, while ILLEGALS steal work and pay to lay their heads in safety, pay for their own food and send money to support their own kind. All of this is being done while U.S.A. are slowly exterminated out of existence.

Set up in place to cater to ILLEGALS is a vast network of 501(c)(3) businesses using taxpayer funds to operate. They range from staffing agencies to free legal services, from special rewards to go to college to catered to medical and dental. All of which U.S.A. citizens DO NOT qualify for.

Millions of U.S.A. citizens have been displaced from work in their own country due to Hispanic/Latino ILLEGALS using trickery with the race card and/or expressing how they are owed something from U.S.A. citizens.

Sen. Ted Cruz, R-Texas, filed an amendment on a new immigration bill that would eliminate a path to citizenship for the 11 million illegal immigrants already here.

Sen. Ted Cruz, R-Texas, a newly elected Republican with a penchant for making headlines, filed an amendment that would bar undocumented immigrants currently living in the United States from ever earning citizenship.

There are an estimated 11 million people living in the country illegally, and a bipartisan immigration reform measure would create a pathway to citizenship over the course of 13 years by requiring those people to pay penalties and back taxes, as well as learn English. Conservatives opposed to reform decry the path as amnesty, but Democrats say they will not support reform that does not cope with the immigrants already living in the U.S.

Cruz also filed amendments that he says would "strengthen border security measures; reform the high-skilled temporary worker program; modernize, streamline and expand legal immigration; and prohibit federal, state or local entitlement benefits for those here illegally."

 

Sen. Ted Cruz: Obama doesn't want immigration bill to pass

"The amendments filed today to strengthen border security and reform our legal immigration system will not only bring meaningful, effective improvements to our immigration system, but also have a chance of becoming law," said Cruz in a press release. "America is a nation of immigrants, built by immigrants and we need to honor that heritage by fixing our broken immigration system, while upholding the rule of law and championing legal immigration."

Cruz isn't the only one throwing potential poison pills into the mix. Senate Judiciary Committee Chairman Pat Leahy, D-Vt., filed a measure that would grant immigration rights to same-sex couples.

 If adopted, that amendment would erode Republican support for the carefully crafted compromise.

 And while it's highly unlikely the Democratically-controlled committee would adopt Cruz's controversial amendments, Leahy's offering very well could be included.

The committee is set to vote on the amendments Thursday.

Ted Cruz, the Anti-Rubio Who Is Determined to Stop Immigration Reform

The Texas freshman has become the face of the GOP opposition to immigration reform—and that could boost the senator’s prospects in 2016, reports David Catanese.

Three weeks after he was elected to the Senate, Ted Cruz delivered a speech in a dimly lit downtown Washington hotel ballroom addressing the thumping his party had sustained at the ballot box, particularly at the hands of Hispanic voters.

“The issue is not, as the media would suggest, 100 percent about immigration,” the Texas senator told the banquet of conservatives, deriding the press corps’s “obsessive”focus on that issue.

“I think Republicans need to remain a party that supports securing the border and stopping illegal immigration and at the same time welcomes and celebrates, champions legal immigration,” he continued, to thunderclaps from the favorable audience. “It ain’t the answer just to suddenly talk about immigration and forget everything else. I’m going to suggest instead a different path.”

Just as the immigration debate is heating up—and Cruz’s own potential presidential aspirations are coming into sharp focus—the 42-year-old Cuban-American is now looking to make good on his word.

No Republican senator has been a more audacious opponent of the bipartisan approach to immigration than Cruz. And being a freshman who has been a part of the seniority-driven chamber for less than four months makes the play even bolder.

“In my view, any bill that insists upon [a pathway to citizenship] jeopardizes the likelihood of passing any immigration-reform bill,” Cruz told the Senate Judiciary Committee in no uncertain terms last week.

Of course, that’s the central tenet of the legislation—pitting him squarely against the bill’s chief sponsor and fellow Hispanic, Florida Sen.Marco Rubio, also a 2016 presidential contender.

If Rubio is set to become the vaunted hero if the compromise holds, Cruz will be remembered, for better or worse, as the wrecking ball if it crumbles.

Since Ted Cruz took office, some people have accused him of being the new Joseph McCarthy.

Even as Rubio has doggedly tried to frame the package as a “border security” bill—complete with new technology to beef up surveillance of high-risk sections of the 2,000-mile Mexican border—Cruz has sliced it up as yet another government boondoggle filled with false promises.

The Tea Party favorite notes that a mere 58 of the bill’s 844 pages address the border-security component and says the proposed security triggers that will be used to legalize new citizens lack real teeth. “There are no objective metrics in place to ensure any triggers in this bill will be meaningful,” Cruz said after a hearing with Homeland Security Secretary Janet Napolitano.

One political adviser to Cruz explained that while the senator has refrained from a full-frontal shelling of immigration reform, it’s highly unlikely he’ll ever get to a place where he can vote “aye.”

If Rubio is set to become the vaunted hero if the compromise holds, Cruz will be remembered—for better or worse—as the wrecking ball if it crumbles.

“Ted really would like to do some real immigration reform in a way that doesn’t alienate Hispanic voters, but the path that they’ve gone down is not something he’s going to support,” said the adviser, who declined to be identified.

“It gives too much control to the Obama administration, allowing them to do studies that he doesn’t believe they have any good intention of doing. The big picture is not a bad sell, it’s when you dive in, that’s where the devil lies. You’ll see Cruz focus on the flaws of the details rather than attacking it on the big picture.”

But while the adviser insisted that Cruz’s position isn’t being calibrated with an eye toward a 2016 White House run, he concedes that being a leader of the opposition to “amnesty” would be helpful in early primary states like South Carolina, where the senator is scheduled to address a state GOP dinner on Friday. National Review reports that Cruz is seriously considering a presidential bid.

The adviser also points out that other reform advocates include John McCain, as well as prominent liberal Democrats such as Chuck Schumer: “I think Marco’s kind of hurt himself here, with the Republican base.” (A Cruz spokeswoman said the senator was too busy for an interview.)

In other words, Cruz in no way wants to be associated with those he sees as the Senate’s “squishes”—a term he recently used to slight some of his Republican colleagues who complained about his aggressive posture during the gun-control debate.

Rubio’s team has every reason to play nice. His playbook throughout the fight has been to engage critics and their concerns constructively—a concerted effort to slowly win, or at least placate, the hearts and minds of the conservative commentariat. There’s no advantage to getting into a public knife fight with the pugnacious and self-assured Cruz, who is building a following with the same grassroots conservatives Rubio will need in a White House campaign.

“We have a ton of respect for Senator Cruz and value his suggestions for how to improve the immigration legislation,” said Rubio spokesman Alex Conant. “We’ve talked a lot with Senator Cruz and his staff and really appreciate their insights. As somebody from a border state with many immigrants, Senator Cruz will have important suggestions for how to help improve the proposal.”

But Cruz’s operation is counting on the entire thing to die, if not in the Senate, then almost surely once it gets to the House. And then Cruz could claim to be the one 2016er who fought comprehensive immigration reform and won.

That would be the textbook play in a Republican primary, based on past experience. Remember the flak that Texas Gov. Rick Perry took last cycle for calling critics of illegal immigrants “heartless”? Or the backlash Newt Gingrich provoked when he declared that longtime undocumented residents should be allowed to remain in the country?

Dan Harvell, a South Carolina GOP county party chairman, said he “totally” agrees with Cruz’s opposition to immigration reform. “I think he’s right, and we don’t need to be so tolerant as many would have us be,” he said.

Yet some Republicans pollsters contend that attitudes in their party are gradually softening, with one recent McLaughlin & Associates survey showing that 66 percent of GOPers support reform that includes a waiting period of several years for those who came here illegally.

“Cruz opposing a security fix that’s needed in immigration reform won’t help,” said John McLaughlin, who conducted the March poll. “On the other hand, if like Sen. Rand Paul he is able to make important changes and helps fix a broken system, he may really boost his standing well beyond his Texas conservative base.”

But some of those who marshal the troops and resources in primary campaigns are not only standing in solidarity with Cruz but notably souring on Rubio.

“I think what Marco Rubio’s doing right now is not how the Senate is supposed to be operated. It’s certainly not deliberative,” said Jenny Beth Martin, co-founder of the Tea Party Patriots.

Cruz “is asking the tough questions, especially in the hearings,” she said. “He’s doing what he can to force the Senate to be more deliberative. That’s a good thing. And the people in the Tea Party movement appreciate that.”

A new Heritage Foundation study claims that the economic impact of the so-called "Gang of Eight" immigration bill that'd make 11 million currently illegal immigrants legit would cost a hefty $6.3 trillion, reports FOX.

Social Security, Medicaid, food stamps and other assorted forms of state aid would cost taxpayers dearly, says the conservative think tank, if such a large number of folks became eligible to receive them as a result of the immigration overhaul.

"No matter how you slice it, amnesty will add a tremendous amount of pressure on America's already strained public purse," said Heritage research fellow Robert Rector. "Those who claim that amnesty will not create a large fiscal burden are simply in a state of denial concerning the underlying redistributional nature of government policy."

The study has been accused, however, by libertarians and even some fellow conservatives of neglecting economic gains in favor of more obvious costs to the state. Anti-tax guru Grover Norquist called the study's numbers "vastly overblown," while the American Enterprise Institute's Madeline Zavodny claimed the data overlooked the awesome expense of any alternative plan, such as mass deportation. I am an anti-racism activist... and even I can see the folly of amnesty. It will do nothing but add to the flow of illegal immigration... as it probably is already just on the chance that America will be making citizens of them all. If I were living in Mexico... and I thought I had a chance of becoming a US Citizen... you can bet I'd be hoping that border. I think the only logical way of dealing with illegal immigration is to give them all a time period to exit the country... and then start locking them up and making use of all the Fema camps and put them to work. If they want to come here illegally to work... put them to work for .30 cents an hour in a camp for a year then deport them... if they come back... give them 2 years of the same. Keep adding a year every time they return... and I bet you that flow of illegal immigration cuts down very quickly. We also should be fining the companies and corporations who employ them and entice them to come here for better paying jobs.

BUT... we should also be prepared to pay more for goods and services as a result of that... but it would not be near the expense we as a country are facing because of them.

Mexico has the opportunity to become a wealthy and prosperous nation, especially since they are booming in certain areas due to NAFTA.   @twinertia Maybe they're worried about losing their heritage/cultural identity. I dunno why that would be, because generally we go out of our way to celebrate every aspect of our mix of cultures, and especially along our southern border not much would change as it is. Perhaps it's a pride thing, maybe joining us would be considered admitting defeat, or maybe its people are so beaten down by crime and its officials are so corrupt that no one would ever propose it or vote for it.

U.S.A. Citizens face Racial Bias as Farms/Employers favor Immigrants: Legal and ILLEGAL

U.S.A. citizens are being refused work in their own country and misleading, misguiding and/or erroneous excuses are being given to support an invading force of people who DO NOT support the Constitution of the United States of America and who lack concern for the harm being down against U.S.A. citizens.

Could it be that the banks, the Department of Agriculture and Academia, as well as, the greed of business owners/shareholders are to blame for U.S.A. citizens being refused work in their own country?

The real price of food by which these people called immigrants is far higher than what is being paid for at the check out. If the actual figures are added in which taxpayers give to programs such as the Finger Lakes Migrant Health Care Program (FLMHCP) and Farm Worker Legal Aid, to name just a few, the actual cost of food is alarmingly high.

An employee of FLMHCP married a worker who was thought to of been in the U.S.A. ILLEGALLY, then shortly after the marriage, they divorced. He now works for FLMHCP.

There are a multitude of programs funded by U.S.A. taxpayers which receives millions upon millions of taxpayers funds to support and/or take care of - often far better than U.S.A. citizens - those in the U.S.A. legally and ILLEGALLY.

VIDALIA, Ga. — For years, labor unions and immigrant rights activists have accused large-scale farmers, like those harvesting sweet Vidalia onions here this month, of exploiting Mexican guest workers. Working for hours on end under a punishing sun, the pickers are said to be crowded into squalid camps, driven without a break and even cheated of wages.

But as Congress weighs immigration legislation expected to expand the guest worker program, another group is increasingly crying foul — Americans, mostly black, who live near the farms and say they want the field work but cannot get it because it is going to Mexicans. They contend that they are illegally discouraged from applying for work and treated shabbily by farmers who prefer the foreigners for their malleability. 

“They like the Mexicans because they are scared and will do anything they tell them to,” said Sherry Tomason, who worked for seven years in the fields here, then quit. Last month she and other local residents filed a federal lawsuit against a large grower of onions, Stanley Farms, alleging that it mistreated them and paid them less than it paid the Mexicans.

The suit is one of a number of legal actions containing similar complaints against farms, including a large one in Moultrie, Ga., where Americans said they had been fired because of their race and national origin, given less desirable jobs and provided with fewer work opportunities than Mexican guest workers. Under a consent decree with the Equal Employment Opportunity Commission, the farm, Southern Valley, agreed to make certain changes. 

With local unemployment about 10 percent and the bureaucracy for hiring foreigners onerous — guest workers have to be imported and housed and require extensive paperwork — it would seem natural for farmers to hire from their own communities, which they did a generation ago.

In fact, the farmers say, they would dearly like to. 

“We have tried to fill our labor locally,” said Brian Stanley, an owner of Stanley Farms, which is being sued by Ms. Tomason and others. “But we couldn’t get enough workers, and that was hindering our growth. So we turned to the guest worker program.” 

The vast majority of farm workers in the country are not in the guest worker program but are simply unauthorized immigrants. The plan to place those workers on a path to legal status would reduce the chances of their being exploited, the bill’s sponsors say, and thereby also improve the status of Americans who feel they cannot compete against vulnerable foreigners. 

Mr. Stanley, like other farmers, argues that Americans who say they want the work end up quitting because it is hard, leaving the crops to rot in the fields. But the situation is filled with cultural and racial tensions. 

Even many of the Americans who feel mistreated acknowledge that the Mexicans who arrive on buses for a limited period are incredibly efficient, often working into the night seven days a week to increase their pay. 

“We are not going to run all the time,” said Henry Rhymes, who was fired — unfairly, he says — from Southern Valley after a week on the job. “We are not Mexicans.” 

Jon Schwalls, director of operations at Southern Valley, made a similar point. 

“When Jose gets on the bus to come here from Mexico he is committed to the work,” he said. “It’s like going into the military. He leaves his family at home. The work is hard, but he’s ready. A domestic wants to know: What’s the pay? What are the conditions? In these communities, I am sorry to say, there are no fathers at home, no role models for hard work. They want rewards without input.”

Such generalizations lead lawyers — and residents — to say there are racist undertones to the farms’ policies. 

“I am not arguing that agricultural work is a good job,” said Dawson Morton, a lawyer who focuses on farm workers’ rights at the Georgia Legal Services Program, a nonprofit law firm. “I am arguing that it could be a better job. If you want experienced people, train them. Just because people are easier to supervise, agricultural employers shouldn’t be able to import them. It is not true that Americans don’t want the work. What the farmers are really saying is that blacks just don’t want to work.” 

To which J. Larry Stine, an Atlanta lawyer for Stanley Farms and other big farms, replied: “The farmers are not racist or against Americans. They have crops to be picked, and they see that domestics just don’t have their hearts in it.”  

Jim Knoepp of the Southern Poverty Law Center, a nonprofit group that has campaigned against the guest worker program, said that farm work, like other difficult labor, could be made attractive to Americans at reasonable cost, and that farmers should not be excused from doing so. 

“There used to be lots of American pickers who moved around the country,” he said. “But wages have stagnated and conditions have deteriorated, and agriculture is unwilling to make these jobs attractive. Think of trash collection. That’s not very appealing, either. But if you offer a decent wage and conditions, people do it.” 

Cindy Hahamovitch, an expert on guest worker programs at the College of William and Mary in Virginia, said that in the 1970s about two-thirds of farm workers were Americans and a third were foreign, and that a decade later the proportion was reversed. Today, she said, the vast majority of farm workers around the country are immigrants, although not in the guest worker program. 

Republicans in Congress, mindful of the Democrats’ desire to bring legal status to the nation’s 11 million unauthorized immigrants, have made an expansion of the guest worker program a key element of any deal. Current proposals include increasing the number and category of temporary workers to the dairy and construction industries, and increasing their stays from a matter of months to three years so that employers have the workers they say they need. 

The guest workers who are planting cucumbers for Southern Valley and harvesting onions for Stanley Farms are among 10,000 holders of H-2A visas in Georgia this year and 85,000 nationally. They are generally guaranteed a minimum wage of just over $9 an hour, but are paid per piece and can boost those wages by increasing their productivity. Other workers, known as H-2B and numbering around 65,000, labor in other businesses in which there is a demand for temporary or seasonal workers, including hotels. 

Employers must show that they have tried to hire Americans through advertising and other means and that they could not attract enough of them before resorting to the H-2 system. In the litigation that resulted in the consent decree with Southern Valley, the federal government argued that the effort had not been made or had been intentionally not serious. Excuses were used not to hire locals or to fire them — training was minimal, and people were fired when they were less skilled than others who had been doing the work for years. 

“You’ve got some people who don’t work as fast as Mexicans, but they don’t teach you, and it can be learned,” said Misty Johnson, who was fired and then rehired by Southern Valley as part of the consent decree. 

For the past few months, Southern Valley has been required to provide daily bus transportation to the farm and demonstrate that it was training and retaining Americans. But a recent inspection of those efforts left federal officials unimpressed. 

Southern Valley officials make no secret of their belief that the consent decree — the free bus, the orientation program they now run and the training — is a waste of their time and money. They assert that there is no discrimination and that they would prefer to hire locals if they could. 

Lawyers for the local workers say the system is rigged to favor low-cost foreign labor because, given the conditions and the pay, no one else will do it. 

“If you can’t find locals to do the work, why is the answer to bring in people who have little protection and not grant them legal status?” asked Mr. Knoepp of the Southern Poverty Law Center. “If we need them, why not bring them in and make them legal citizens with real protections? The answer is because then they wouldn’t keep working in the fields given the conditions of that work. They would do something else. It doesn’t have to be this way.”
